Rules for using ORIXIVA, its website, tools, accounts and digital services
| EFFECTIVE DATE October 5, 2026 | APPLIES TO Orixiva.com and related services | CONTACT sardarzain45786@gmail.com |
1. Agreement to These Terms
These Terms & Conditions (“Terms”) govern your access to and use of Orixiva.com and related ORIXIVA services, including free browser-based tools, digital-product pages, accounts, shopping-cart and checkout functions, downloads, customer support, and other content or services made available by ORIXIVA. By accessing or using the website, you agree to be bound by these Terms. If you do not agree, do not use the website or services.
If you purchase a digital product, the Digital Product Terms & Refund Policy also applies. If a product page contains specific license, usage, delivery, or refund terms, those specific terms apply to that product to the extent they conflict with a general statement in these Terms.
2. Who We Are
The website is operated under the ORIXIVA brand. For legal notices, replace the placeholders below with the actual contracting entity before publishing:
- Legal / business name: [Insert legal business name]
- Business address: [Insert business address]
- Legal/privacy contact: [Insert email address]
- Website: https://orixiva.com
3. Eligibility and Responsible Use
You must be legally capable of entering into a binding agreement under the laws that apply to you, or use the service with the involvement of a parent, guardian, or other legally responsible person where permitted. You may not use the website for unlawful, fraudulent, abusive, infringing, deceptive, or harmful activity.
4. Website and Service Availability
ORIXIVA may add, remove, update, suspend, or discontinue features at any time. We do not guarantee that the website, a tool, an account area, checkout, or a particular feature will always be available, uninterrupted, secure, or error-free. Planned or unplanned maintenance, third-party outages, browser limitations, network failures, security events, and other factors can affect availability.
5. Free Browser-Based Tools
ORIXIVA may offer free tools for file conversion, editing, analysis, extraction, formatting, document processing, image processing, and other functions. Tool outputs are generated by software and may contain errors, omissions, formatting differences, or compatibility limitations. You are responsible for reviewing the output before using it for business, academic, legal, financial, publication, or other important purposes.
Where a tool is designed for browser-first processing, your selected files may be processed locally in your browser and are not intended to be retained by ORIXIVA as a permanent file archive under the current free architecture. This does not mean that no network requests occur: webpages may load libraries, models, fonts, advertisements, security services, or other third-party resources.
6. User Files and Content
You retain your rights in files, text, images, documents, data, or other material that you provide to ORIXIVA, subject to any rights held by third parties. You are responsible for ensuring that you have the right to use, process, convert, upload, download, or otherwise handle any content you submit to a tool or service.
You must not use ORIXIVA tools to process material in a way that violates copyright, privacy, confidentiality, trade-secret obligations, contractual restrictions, export controls, sanctions, or other applicable law. You should not submit passwords, payment-card numbers, government identity numbers, health records, or other highly sensitive material unless the specific service expressly supports it and you have an appropriate lawful basis for doing so.
7. Accounts and Security
Some features may require an account. You are responsible for providing accurate information and maintaining the confidentiality of your login credentials. You must promptly notify ORIXIVA if you believe your account has been accessed without authorization. ORIXIVA may suspend or restrict an account where reasonably necessary to protect users, the service, or third parties.
8. Digital Products
ORIXIVA may sell digital products such as templates, spreadsheets, trackers, documents, graphics, files, bundles, and other downloadable or digital materials. Purchases are subject to the Digital Product Terms & Refund Policy, together with any product-specific description or license displayed on the product page.
9. Product Descriptions and Previews
We aim to describe products accurately. Screenshots, previews, sample files, feature lists, and demonstrations are for product representation and may not display every included file or future update. Product contents are determined by the product listing and the files provided at the time of purchase, together with any expressly stated updates or support commitments.
10. Orders, Payments and Pricing
Prices are displayed on the website at the time of purchase unless a clear error is present. Payment may be processed by third-party payment providers. By submitting an order, you authorize the applicable payment provider to process the transaction under its own terms and privacy practices. ORIXIVA may refuse, limit, or cancel an order where permitted by law, including in cases of suspected fraud, duplicate transactions, pricing errors, or misuse.
Taxes, duties, digital-service taxes, or other government charges may apply depending on your location and the checkout configuration. Where ORIXIVA is required to collect a tax, it may be added at checkout or otherwise handled as required by law.
11. Digital Delivery
Digital products are normally delivered through the website, account area, order page, email, or a secure download mechanism after successful payment or confirmation. Delivery may be affected by payment verification, email-provider filtering, browser settings, temporary outages, or anti-fraud controls. You should contact support if an expected digital delivery does not arrive.
12. Intellectual Property
The ORIXIVA website, branding, logos, page layouts, original text, graphics, software, code, and other materials owned by ORIXIVA are protected by applicable intellectual-property laws. Except for rights expressly granted to you, no ownership or license is transferred to you by browsing the website or purchasing a digital product.
13. License and Permitted Use
Unless a product listing states otherwise, a purchased digital product is licensed, not sold as a transfer of copyright ownership. The default license is for the purchaser’s personal or internal use. You may use the product in your own permitted work, adapt editable files for your own use, and make reasonable backup copies for your own access.
14. Prohibited Digital-Product Uses
- Reselling, sublicensing, redistributing, sharing, gifting, uploading, or publicly posting the original files as a competing or replacement product.
- Making the original or substantially similar files available through marketplaces, file-sharing websites, public repositories, membership libraries, or free download sites.
- Removing ORIXIVA attribution or copyright notices where the product license requires them to remain.
- Using ORIXIVA files to create a competing template, bundle, membership library, or downloadable product whose primary value is the ORIXIVA file itself.
- Different products may have different licensing permissions. Always follow the most specific license stated on the product page, included license document, or order materials.
15. Prohibited Website Activities
Attempting to gain unauthorized access to accounts, systems, APIs, databases, or administrative areas.
Interfering with website operation, security, performance, or availability, including abusive automated traffic or denial-of-service activity.
Using the service to distribute malware, phishing content, illegal material, or material intended to deceive or harm others.
Scraping, copying, framing, republishing, or systematically extracting ORIXIVA site content in a way that competes with or harms the service, except where allowed by applicable law or explicit written permission.
16. Third-Party Services and Links
ORIXIVA may rely on third-party hosting, payment, advertising, analytics, content-delivery, fonts, authentication, email, security, or other services, and may link to third-party websites. Third-party services are governed by their own terms and policies. ORIXIVA is not responsible for third-party services that it does not control, including changes, downtime, pricing, privacy practices, or content.
17. Advertising and Cookies
ORIXIVA may display advertising and may use cookies or similar technologies for site operation, preferences, analytics, security, and advertising. The Cookie Policy explains these practices and how optional technologies may be managed. Where applicable, ORIXIVA will use a consent mechanism appropriate to the visitor’s region and the services being used.
18. Privacy
The Privacy Policy and related privacy pages explain how ORIXIVA handles personal information and browser-based tool processing. By using the website, you acknowledge that data may be handled as described in those policies, subject to applicable law and any choices or rights available to you.
19. Disclaimers
To the maximum extent permitted by law, the website and services are provided on an “as available” and “as is” basis. ORIXIVA disclaims warranties that are not expressly stated, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation, except where such warranties cannot legally be excluded.
ORIXIVA does not provide legal, tax, medical, financial, academic-integrity, cybersecurity, or other professional advice merely by providing software, templates, educational materials, or informational content. You are responsible for obtaining professional advice when appropriate.
20. Limitation of Liability
To the maximum extent permitted by applicable law, ORIXIVA and its owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, business opportunity, or anticipated savings arising from or related to use of the website or services.
Where liability cannot be excluded, the maximum aggregate liability of ORIXIVA for a claim relating to a paid digital product will be limited to the amount you paid for the specific product giving rise to the claim, unless applicable law requires a greater amount. Nothing in these Terms excludes or limits liability that cannot legally be excluded.
21. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless ORIXIVA and its service providers from claims, losses, liabilities, damages, costs, and reasonable expenses arising from your unlawful use of the website, violation of these Terms, infringement of third-party rights by content you submit, or misuse of purchased materials.
22. Suspension and Termination
ORIXIVA may suspend or terminate access to an account, tool, or service where reasonably necessary for security, fraud prevention, legal compliance, protection of other users, or enforcement of these Terms. Termination does not automatically eliminate rights or obligations that by their nature should continue, including intellectual-property restrictions, payment obligations, disclaimers, limitation of liability, and dispute provisions.
23. Changes to the Website or Terms
We may modify these Terms to reflect changes in services, pricing, technology, legal requirements, or business practices. Material changes will be posted with an updated effective date. Continued use of the website after changes become effective means you accept the updated Terms to the extent permitted by law.
24. Governing Law and Disputes
These Terms are governed by the laws of [Insert governing jurisdiction], without regard to conflict-of-law principles, except to the extent mandatory consumer-protection law requires otherwise. Before filing a formal claim, you agree to contact ORIXIVA at [Insert dispute/contact email] and give us a reasonable opportunity to resolve the matter. Any court venue or alternative dispute process should be inserted here only after confirming the applicable law and the business’ actual legal setup.
25. Consumer Rights
Nothing in these Terms is intended to remove or reduce mandatory rights, remedies, warranties, or protections that you may have under applicable consumer or other laws and that cannot legally be waived.
26. General Legal Provisions
No Waiver
A failure to enforce a provision is not a waiver of the right to enforce it later.
Assignment
You may not transfer your rights or obligations under these Terms without written permission, except where such restriction is prohibited by law. ORIXIVA may assign these Terms in connection with a business transfer, reorganization, or similar transaction, subject to applicable law.
Entire Agreement
These Terms, together with the applicable Privacy Policy, Cookie Policy, Digital Product Terms & Refund Policy, and product-specific terms, form the agreement governing the relevant use or purchase, subject to any mandatory legal rights.
Electronic Communications
You agree that notices, order confirmations, support messages, and other communications may be provided electronically, where permitted by law. You are responsible for keeping your email address current for account and order communications.
27. Contact
General legal questions, notices, or complaints may be sent to [Insert legal/contact email]. Include enough information to identify the relevant page, order, or issue, but do not send unnecessary payment-card or authentication information.
